He didn't say in the listing that it was new and sealed? Unless he had another Now 63 auction. It's irrelevent anyway - you should assume it was not an illegal copy. Report him!

yeah it said new and sealed ive emailed them but got no reply so far i will report them but some people say on there listing that there back ups which is the better word for copies and ebay dont do anything about those idiots!!!!

Yep, definetely report it. I wouldn't hold your breath in regards to getting your money back though
