I'm always getting people copying bits of my website and pictures, but this takes the biscuit. *URL Removed - Content not suitable for family forum*
Thanks to CB Entertainments for the heads up. I know he's in the States, but that's not the point.
Has anyone got a copy of a cease and desist letter I can send for this?

Blaming the web designer seems to be a common excuse - I've heard that several times from people who have nicked bits from me before.

BELIEVE YOU HAVE A GOOD CASE TO PRESENT TO THE AMERICAN TRADING STANDARDS AS WELL All you have to prove is your site was established well before his and you hold the original Photo's on your person you could scan to them, and they can shut him down with I believe its called a 48 hr termination order (dont quote me about this). But a cease and desist letter from your solicitors with a view for a compensation order would work as well
Sorry all caps got stuck on
contact the hosting company. They will investigate and if they are a good company will suspend his account.

There is nothing wrong with getting ideas from other peoples sites but this guy is just a 100% Cheapskate.
I would send him a personal email and threaten him with legal action, i would also contact the hosting company and provide them with the email that you have sent him.
I had this done to me a few months ago and i wasn't very happy about it.... took him 3 days to take it down.

The thing is it isn't hard to come up with your own material or create your own site... Doesn't take that long to do it yourself or employ a pro to do it for you. These guys are just A class freeloaders and it just gets on my nerves the more and more that they do it.
I have had a dj once copy all the text content from my website and he didnt even change the text where it had my company name. I was going to say to him why dont you just put a picture of me and my rig on there aswell. He didnt reply to my email after that and then took the site down and now has appeared to have ceased trading unless he is trading under a different name.

That's not necessarily true. Writing your own material, editing it for keyword density AND readability, and still being somewhat original and creative may be easy for you and me... but it's by no means easy for everyone, hence why some people take the cop-out.

Well why copy ? There is always help out there getting your content together.
Doensn't have to result in stealing.

Hi, if this still hasn't been solved, your safest bet is to issue the guy's isp with a takedown request. In the US, they have what are known as 'safeharbours' that protect isps from liability for hosting infriging material (like your site)... ISP legal teams are usually eager to avoid litigation and are pretty streamlined at taking down infriging material.
[ironically, the information below was taken from www.chillingeffects.com]
Question: What are the notice and takedown procedures for web sites?
Answer: In order to have an allegedly infringing web site removed from a service provider's network, or to have access to an allegedly infringing website disabled, the copyright owner must provide notice to the service provider with the following information:
The name, address, and electronic signature of the complaining party [512(c)(3)(A)(i)]
The infringing materials and their Internet location [512(c)(3)(A)(ii-iii)], or if the service provider is an "information location tool" such as a search engine, the reference or link to the infringing materials [512(d)(3)].
Sufficient information to identify the copyrighted works [512(c)(3)(A)(iv)].
A statement by the owner that it has a good faith belief that there is no legal basis for the use of the materials complained of [512(c)(3)(A)(v)].
A statement of the accuracy of the notice and, under penalty of perjury, that the complaining party is authorized to act on the behalf of the owner [512(c)(3)(A)(vi)].
Once notice is given to the service provider, or in circumstances where the service provider discovers the infringing material itself, it is required to expeditiously remove, or disable access to, the material. The safe harbor provisions do not require the service provider to notify the individual responsible for the allegedly infringing material before it has been removed, but they do require notification after the material is removed.

Also, both the UK and US are parties to the WCT (World Intellectual Property Organisation Copyright Treaty) and recognise the 'making available right' that is in this treaty...This guy is clearly in breach of your making available right by copying your source code.

There is a web site that allows you to put a url in and it will show you what the web site looked like a year ago, two years ago etc.
Handy if you need to prove your web site existed first.
I can't dig it out while I am at work but will attempt to do so over the weekend.

Re-re-wind....
I have just found it. Its the 'waybackmachine' and it is at http://www.archive.org/index.php
type your url in and it will tell you the dates it took a snapshot of your site and you can click on them and look although things like picture links etc. might not work properly after this time, the code is still there.
Daz, your archive goes back to 14 Feb 2005. Take a look.

How would you reply?
The fact that you couldn't would just make you look stupid.
In my opinion, It's not a good idea to make claims you can't prove, because if someone DOES ask you to prove it, you're knackered...because you can't!

Well in Callum's case, he could easily make a claim along the lines of how quickly he has established himself, despite his age etc. He could focus on the growth and progress of his company (?) in such a short space of time - he could be 'leading' in this context.

Done!.
Charming comments he posted though. I wonder what his customers will think of him!
Do you really think this guy has customers? What was with the 5 Brits vs 1 American reference - is that you lot closing him down? Serves him right really, the complete FOOL!

That's just him being very childish I would assume.

No professional in their right mind would put a message like that on their website.
He's been found out & doesn't like it.
How pathetic.

Well, although the comments werent very appropriate for a family forum, I was going to leave then there to show what an idiot the man is, but Shaun posted at the same time and has deleted the URL, which is fair enough. Go to the supporters area if you want to see what he put.

To give non-supporters a rough idea, here's the clean version of what the guy has on his website now:
Sorry under construction at the moment
Heres a fact: British men are all :Censored: and have small :Censored: . Its no wonder all their women look for american men to "take care of them" A bunch of bonifide :Censored: . 5 Brits vs 1 American is a fair fight.

You think you've got problems?

Well someone's at it for sure... and that someone clicked through from one of my postings on this very forum at 21:15 tonight, waded through a number of pages until 21:24 and then saved my 'Wedding Dances' page to their c:\ drive.
Now I know imitation is the best form of flattery but asking permission would have been nice

Did cross my mind... 'til I looked at the choice and order of pages that were viewed in the visit... very unusual selection for a potential customer, very likely selection for a DJ ;)
Still... it's out of date anyway and will be getting a revamp in the next couple of days with the whole 'weddings' section so yah boo sucks! :D

Yeah, but it's still relatively little work for them as you've already done it, especially as your "out of date" cast-offs will still be better than the vast majority of site material out there.

Does that include bookmarking (safari on mac) or saving in favorites? surely that saves a copy of the link on the hard drive?
Vectis

Nope. It was saved as an MHT file on the local computer - that's an archive copy of the webpage/site and other pages it links to with all the link definitions edited to work locally.
