I was told this at a venue last night wondered where we stand ?

I was doing a party in a hall last night the lady in charge told me to watch the sound levels as they had a noise obaitment order on them and if the police were called my equipment would be ceised :eek: wondered if this was true ? made me nervous all night.

If the law here is the same as in NZ, then yes, if the venue has had an abatement notice served then it would be your gear seized if another complaint is received.

That's my understanding of the law, too. However this would be VERY unlikely to just happen without a visit by environmental health inspectors and/or dibble and a warning being given first.

Surely if you were visiting the venue for the first time and could prove it then your gear would be safe? Also, when people say that your equipment could be siezed...does that mean that the plod can keep it and you never see it again OR you have to pay for it to get it back? I just find it totally out of order that the venue has been threatened because of what they have done in the past and you could go there for the first time and be the victim.

Lastly, how would you know if a venue has this kind of thing tied to them? Is it normal to ask the question and maybe have it on your T&C's etc? Saying that, what if the venue had it tied to them and didn't tell you and you got your equipment taken away?

Yep, very unlikely.
The last thing plod would want to do is take any property away. But technically they could but only after all other solutions have failed.
And plod only work with environmental health in extreme circumstances when there is a danger of violence, otherwise it would be letters and a court summons for the venue, not you.

Generally venues are obliged to advise if such a notice has been served and yes, you should have something in your Ts & Cs to cover this situation. If an abatement notice is in place then any complaint means they are in breach... not sure if the environmentals need to be involved at that point. Abatement is abatement, and a complaint means abatement has been breached.

Seriously (and I know I'm against them completely) shouldn't they get some sort of sound-limiter if this is the case? This would solve all their problems and avoid the potential ceasing of gear.

I thought that was the main reason for limiters anyway :confused:

I would have thought that Enviromental health would have gone down the limiter road first - its probably bull to get DJs to keep the volume down without having to pay out for limiters to be installed.

If the police were called to a gig you were doing, I don't think there would be even the slightest chance of them confiscating your gear due to past problems at the venue with OTHER discos.

I agree that it's probably just a ploy to try & get discos to play quieter without going to the hassle & expense of installing a limiter.

The police do use these powers but usually only in the case of unlicenced rave type events or private parties where they get complaints. They nearly always give one or more warnings first. In the case of a pub, hotel, village hall etc I am sure that the first course of action would be a limiter and ultimately the withdrawal of the entertainment licence by the council.

I think that it sounds like scare tactics,to get you to reduce your volume.You would expect the party organisers to tell you this when they booked you,surely they would have been told that there was this problem with noise when they booked the hall.

Some halls are a nightmare like this for us djs

How many discos have had their gear confiscated due to OTHER discos playing too loud at a venue in the past?

ive tried to phone the police every week for a month because of our neighbours constant 2am windows open rnb parties .......... everytime .....

every week at 2am we phone the council........

"sorry our offices are closed at the moment please call back monday to friday between 9am and 4pm or leave a message and we will get back to you when the office opens"
