View Full Version : Deposit from minors and now disco cancelled

Hi,

I charge a set amount as a deposit to confirm a booking.

I received an enquiry by email and confirmed the cost and deposit. The deposit was sent by cash and I contacted them by phone to confirm. There seemed to be some confusion about the party.

It was then found the person who booked it was 15 (using all his money) and his Mum told him he couldn't have it so it was cancelled. She never knew a disco booking was made. She then tried to get the full deposit back.

Generally cancellation of the disco means they lose their deposit but I said she could rearrange another disco at a date suitable for both myself and her but she didn't want to do this. This is something I generally never do as if you cancel you lose the deposit - no movement of dates.

I clearly state the terms online, do I stand correct legally with what I've done? As I cannot see anything with regards to the client being 15 years old.

Any help appreciated!

The contract will be void because it was signed by someone under 18, so I assume you'd have to give the money back.
