i sold my ec euro speakers on ebay via DHL and then got this message.


Hi Mate. Speakers arrived but because of the lack of padded packaging one is smashed and unuseable.
I would therefore appreciate a refund as I will be returning them to you. You can contact me on *********** Thanks

That is very unfortunate, I myself have sold speakers and a heavy guitar amp on ebay and wrapped them with bublewrap. Luckily, they both arrived undamaged.

Firstly, did you offer insurance and did the guy take it?

Secondly, call the guy and ask him to take photo's of the speakers and ask if he can email you them before you decide what action to take.

Thirdly, where they recorded delivery (i.e. did he have to sign for them). If he's signed for them then it's his responsibility to check the items first.

Hope you get this matter resolved but I'm sure there will be plenty of advice coming from here ;) :D

As above, if you offered insurance and they took it then speak to DHL. If he didn't take it and it was signed for (which I presume it was) then it's a case of bad luck.

The problem you'll have is showing how much bubblewrap you put round it (do you have any pictures?) prior to dispatch. DHL will just say that the padding wasn't ample enough so it's nothing to do with them.

That is very unfortunate, i can amagine just how anoying this situation must be, firstly you sold your speakers in good condition, secondly your now getting them back broke, and thirdly you have to pay the money back (hope you havent spent it?).

Ahhh?

Did you write: FRAGILE HEAVY ITEM on boxes? Just how well did you pack them?
Did you list them as SOLD AS SEEN / NO RETURNS?

There must be a solution surely? You need to get the real hard facts together first before you make your case.

This is true, unless it's absolutely perfect packaging, they will not accept liability. I know this from previous dealings when I've used them before.

I received an email from the guy saying it was damaged so I rang DHL and asked them where I (and the buyer) stood on insurance. They said it was only wrapped in bubblewrap and thus not 'properly' packaged. They wouldn't budge on this at all, no matter how much I argued with them.

Luckily at the time, I offered insurance, he refused it and signed for it.
He rang me and said that I knew it was damaged before I sent it. A few harsh words later and he said he'd get it fixed himself and slammed the phone down.

Funny thing is, I still got a very nice positive feedback comment from him a week later. :D

If you accepted payment by Paypal - I think youre covered for upto £500.

Thats why I always buy / sell anything expensive with paypal now - despite the extra few quid charge.

As an ebay novice, I seem to remember CJ is registered as a Business Seller. Does this alter anything? :confused:

This is what you need to do:

A: You need pictures of the damage
B: You need pictures of the packaging very important.
C: Check if the customer signed the manifest in good condition,

I assume you used a broker to send them, parcel2go ? Or did you do direct with dhl, The later is better for pay outs.

You would be looking a couple of weeks if not months for compo pay out, This is provided you packed them adequately as they will always use this as a get out.

2 choices, Either take them back now and refund

Or

let him open paypal dispute and risk him getting a refund and you get no speakers back

The later will buy you a bit of time, If you dragged the dispute out, And then mutualy refunded him at the last chance possible,

How did you pack them also ?, If just bubble wrap and no box you wont get any payout mate, :(

Seriously guys if you saw the way couriers drive and treat packages you would take insurance out every time.

would be uneconomical to fix, Refund the guy and try claim from dhl, However if thats all the packaging you wont get paid,

Take it on chin and learn from mistakes mate

even though he signed for them etc?? i put bubble wrap all the way around then some back bags.

im just so gutted.

to day i rang class D and they offerd me same cab. and then i offerd it him and he refused it.:bang:

They wont accept as bubble wrap mate, Who did you send it with , If you sent direct with dhl you may and i mean may stand a chance,

If you used parcel2go then mr kramer will not pay out

The one from class d woudlnt be badged up ac euro though ?, He would have 2 diffrent makes ? The only way to minimise cost would be if you could replace the damaged one with one exactly the same

if only so easy, He paid via paypal, cj is now under there control, The goods arrived broke cj must refund, Harsh as it is and unfair thats how paypal work,

thats why if you sell anything on ebay make sure you can package it extremely well, And carry out fraud prevention checks before releasing orders if your selling valuable items, Seen alot of people get conned on ebay or ripped off, But it usualy happens just the once

there the same just differnt bages. and i sent it via interparcel LTD.

Different badges is enough mate, To says its not the same item, Will have diffrent drivers in them and compression driver i would say at least,

Try speaking to interparcel mate, Start a claim id be surpised if you got very far, I am not familair with there cond of carriage for dhl, I'll have a look on there website

Do I sign for my goods if they are damaged?
If the goods are damaged, please sign to accept but note that the goods are damaged.

If you sign for the goods in 'Good Condition' you will not be able to process a claim.

Do I need to keep the packaging?
If the goods are damaged, packaging must be kept in case the goods need inspecting with the packaging.

If the packaging is not kept this could invalidate your claim.

Are there any exclusions to the Transit Cover?
There are some exclusions that prevent you from making a claim. For example, you will be unable to claim for any items on our Prohibited or restricted Items list, or if the item was not boxed or packaged sufficiently.

Damaged / Lost Claims

The maximum claim value is the transit cover that is chosen at the time of ordering.

Each service includes a limited £50 Transit cover against loss or damage (apart from the Interparcel Premium service which is £150). Enhanced cover can be added during the ordering process up to the maximum consignment value of £1000.

Any enhanced cover that is selected replaces the inclusive cover.

The claim will be paid to the sender only, the details entered at the time of ordering. Please ensure the exact name or company name is entered at the time of booking as we will charge £10.00 if the cheque needs to be re issued.

In the event of a claim a copy invoice will be needed to be provided to prove the value of the consignment/s.

In the rare event of damage all packaging must be kept for inspection by the carrier. The item must be available for inspection in the state it was delivered, at the address it was delivered to. If the item is moved / repaired or if the packaging is not kept any claim will be voided. Photographs of the internal and external packaging as well as the damaged item must be supplied to start a claim.

In the event of damage repair costs must be supplied. If the item cannot be repaired then we would need this in writing from a specialist for the full claim amount to be considered.

In the event that a claim is approved and repair costs are paid, no postage will be paid. Postage costs are only paid on approved claims where the full value of the goods have been paid.

A lost claim can only be processed once the carrier has made extensive searches and deems the goods as lost.

Any claim must be brought to us within 10 days of receipt in the case of delay/damage, and 28 days in the case of loss.

Claims can only be re considered up to a period of 12 weeks after despatch as the carrier only holds records for up to this period. If you wish to contest any claim decision, please write in to the Customer Service Director within this period.

Interparcel aim to resolve any claim within 28 working days.

Exclusions

A receipt must always be obtained on collection of your consignment. No claim can be made if a collection receipt has not been obtained as there is no proof that the carrier has collected the parcel. In such a case a full refund will be given as there is no proof of service taking place.

Your consignment/s must be packed to a professional standard, packed within a double walled box with the contents cushioned and protected inside. The packaging must also be sufficient to protect the products weight. Any claim resulting from a parcel that is not packaged to a professional standard and in line with the above will be declined.
In addition the sender will be liable for any damages caused in transit to other shipments or property resulting from sending a consignment that is insufficiently packaged.

Bubble wrap and a black bag are not adequate packaging in my opinion. If I bought second hand goods and they arrived damaged with the type of packaging stated...I'd be annoyed and would want a full refund too. I ALWAYS sign for goods as unchecked to avoid any problems late on.

The offer of a similar (if not identical) speaker with a different badge on it wouldn't acceptable either.

CJ. Pay the man his refund, and try claim from the courier. I think you might have a good case with the severity of the damage shown in the picture.

now ive offerd him is 100 payment for the speakers he only losses out on P+P.

up 2 him now.

Yeah but he is entitled to his full money back, Its how ebay and paypal work, Not matter what clauses they put in there auctions, Its paypal who decide mate, And thats how it goes,

He would however have to return the cabs to you to get his refund with paypal

I should hope not.

I hope you've learned never to send items with inferior packaging. I hope you've learned that the right thing to do, would be to do right by the guy that purchased from you in good faith. Quite frankly I'm astonished that you're still trying to haggle over the amount to send back to him. He's the only one that is completely guilt free in this situation. The blame lies with you for not packaging correctly, and also with the courior for damaging the goods via transit.

Pay the guy his full amount of money back!

its a bummer mate, but your doin the proper thing, Refund him in full when he returns the speakers to you,

And then if you can maybe sell the undamaged one as pickup only to recover some of your loss.

This is the downfall of ebay, But as you say you will never do it again

Sorry to hear about this CJ.

I personally wouldn't sell any large heavy items such as speakers or consoles unless it was done as "buyer collects"

I know you're restricting your potential buyers to those who live fairly locally, but you have no postage costs, they can see & hear the item working and you both know what condition it's in, so they can't come back later & say it doesn't work or it is damaged.

When you sell remotely for a price including delivery then the delivery forms part of your contract and your sole responsibility. Should you choose to subcontract the delivery aspect then the onus is on you to resolve any issues arising.

Your contract with your customer and your contract with your subcontractor are two entirely different arrangements and engagements.

Pay the man everything back and arrange collection of the goods at your own expense. Then consider your contract with your delivery subcontractor to seek redress.

right, refund is being made.
and I'm getting the cabs back. so im of to Mansfield on Saturday to collect new cabs then i'm going to keep them or do what ever i can.

a good lesson has been made and it will NEVER happen again.
