For legal reasons i cant name the brand of speakers im about to talk about.
I bought a full set of speakers in January this year,up untill a few weeks ago no problem with them at all.
First problem was both top speakers started ratling from the rear of the cabs, they were returned to the retailer and were duly fitted with new drivers as the owner stated that both had suffered magnet problems through no fault of mine and replaced both drivers free of charge.
A week later i set up my rig only to find when i powered it up that i had one subb failed, usual checks proved nothing so this was returned to the retailer and he opened up the cab to find a broken crossover which he said he had seen before on this particular unit. This was repaired so away we went again.
This Saturday we set up only to find that not one but both bass cabs had failed leaving me with no bass at all and no choice but to contact the retailer to explain the problem and ask if he would cover the bill to hire in a system so my clients could have the package they had bought and paid for.
He agreed eventually to bring me a new pair out to the venue,i explained that by now we had had enough of the problems repairs had broken again and i wanted a full refund.
He said we could sort this out after the weekend.Today i had a call from his wife saying they werent prepared to refund even thoiugh i had all the problems which they admit was nothing to with what we had done.
My question is my busisness is now suffering from this and i really think that given the problems i have had i should be given a full refund.
The brand is uk made not cheap and very popular with pro djs i must be unlucky what do you think.:(

Call to trading standards. They are obviously not suitable for their intended purpose so you should be entitled to a refund.
How did you pay for them ? Cash or by credit card. If it was a credit card then you should also contact the credit card company.

According to the retailer they say trading standards have told them because its a busisness to busisness transaction my grounds arent the same as a normal individual buying so im not entitled to a refund.
We just cant trust them they have failed in one form other now for the last four weeks causeing stress and problems for me and my clients.

The retailer is correct to state different conditions apply for B2B transactions as opposed to B2Consumer transactions. However, for domestic/consumer disputes you would have to go to Consumer Direct as opposed to Trading Standards so TS is the correct organisation to approach.
However, you bought the speakers in January so it could be said that your right to a refund has expired. So, far you have been happy to accept repairs (when you should have insisted on a refund the first time they went wrong). I think TS would state that the retailer has acted properly so far as they've been carrying out the repairs for you. So, you have two options. The first one is get an independent engineers report (at your cost) to try to confirm the fault is inherent. The second option is to attempt to show the repairs are not fit for purpose. I'm at work at the moment but I'm sure someone like Angela will be along soon to give you some proper advice!

I had a simlar problem with some radio mics, had them repaired as the kept dropping out, then a few months later they went wrong again had a brand new set, these lasted about a week. I rang trading standsrds also and they said it made no difference that it was buissness to buissness, they itme were faulty, under trading law, thay said thay go by the "3 Rs" repair, replace, refund, as I had had the first 2, the only option was a refund, which the shop gave after I quoted what tradindg standards had told me, the goods must be fit for purpose. I would keep on at the shop if I were you and ring tranding standars/consumer direct and get a reference no.

Hi guys contacted ts and consumer direct, have been given a referance number.
The problem is with the crossovers they keep breaking apparently with the bass cab vibration due to not enough support.
I want a refund due to the unreliability and it causeing stress to me and potentially my clients.
I have contacted the retailer and manufacturer both arent prepared to offer a refund i have said i will publish the maker if they dont refund as i believe a lot of djs etc could buy these and suffer the same problem, and i know a lot of djs down South do in fact use them.
Charlie i cant publish the maker due to legal reasons ie they wanting to sue me.

In which case there is an inherant design fault and they are not fit for purpose. Designing a crossover is not rocket science neither is assembling a robust circuit board. Sounds like a combination of poor design and bad manufacturing processes and a severe lack of quality control. :(

They can only sue you if you intentionally cause damage to their company by lying about them. As long as your account is truthful you can name both retailer and brand without fear of (legal) retribution.
You're entitled to a refund. Threaten to take the retailer through the small claims court for a refund and ask him what a judge might think...?

Would be interested to know the brand ,so I know that the manufacturer has a fault and are not fixing it.

Certainly at the time this thread was posted:-
For legal reasons i cant name the brand of speakers im about to talk about.((That was the opening line of this thread)
However, may be things have changed since then, and if it has been sorted, it would be nice to have an update.
