Returning items

I've just been reading something on Ebay which basically said if an item is damaged then the seller is not responsible for paying to return the item, though they will give a refund for the item.

Anyone know what the law is on this?

I thought it was dependant on whether the buyer was charged for delivery?

Depends on whether the supplier and/or the buyer are consumers or businesses as to which parts of the DSRs apply.

My understanding is that B->C transactions are fully covered by the DSRs and the supplier must absorb the cost of collection.

B->B and C->C/B are where it gets confusing as to whether the regs apply or not. Also if the B is overseas.

Agreed on DSRs, but if you go under the Sale of Goods Act, then there is a little known part which states that you can claim for consequential compensation, and the Sale of Goods Act applies equally to consumers and businesses. I have successfully argued with certain companies that we could claim compensation under SGA to cover the cost of the postage.

However, it's been a while since I investigated, so I couldn't quote chapter and verse without looking it up.
