is a digital license still required or does this cover it, and how much is a vpl license?
MCPS require the sum of £1,175 (inclusive of VAT) as a non-returnable advance payment
then 6.0% of the revenue per gig.
so £6 per £100 earned to MCPS-PRs, is that before or after tax and would it be classed as a business expense and tax deductable?
Sorry for all the questions, just need a better understanding before i part with some dosh

So if i'm reading it right, the initial £1175 is an upfront payment, therefore no more money is payable until you exceed this with the 6% of earnings. And no limit on the copying of music.
It also says on the accounting form Gross music revenue.
BUT this

how on earth will this be done?

I see no mention of any goverment affiliation for this. 6% with a large upfront payment seems very steep as well.

it's the royalty payment to mcps-prs
Thames Valley Discos

To be honest, if it allows copying of music, djing etc, then on an average £300 disco, you only pay £18. That seems ok to me. The more you charge the more you pay.
Yes the upfront payment is high, but that will cover a lot of gigs before the regular payments start.
I have emailed them asking to clarify what is now needed for mobile djs. I think the answer is above but i will hopefully be more in the light tomorrow.
Reading again it says
The rights licensed under this scheme will be limited to copying of Musical Works and supply of such content for playing to the public in premises based anywhere within the EEA as follows:
1.1
The creation of a digital database of audio-only or music video tracks to source for supplying the service;
So i'm not really sure why a VPL license is required,( if doing videos at discos) therefore i have emailed them too for clarification.

The SG5 is definitely NOT a licence you want..... it relates to BACKGROUND music in premises (eg a pub playing CDs throughout the day)
The SG Licences have been around for ages: but it was the SG6 Licence that it was argued was needed in conjunction with the PPL Digital Licence. But even with these 2 licences together, the situation was far from covered; hence the LWP trying to negotiate a new licence that does cover the DJ's situation.
Nothing has changed Paul.

As for the blurb mentioning karaoke - I really can't say, especially since I've read the actual licences and it contains a clause:-
For the avoidance of doubt, the Licence does not extend to the graphic
representation of lyrics of Repertoire Works in any format whatsoever.
...which would mean that it would allow you to make a copy of the original disc, but not display the lyrics!

I have an SG6 licence which allows me to copy any track to other format (1 copy only) curtesy of MCPS.
The SG5 is for making karaoke tracks, background discs etc, not for djs playing music, whatever the format.
Check the LWP site and look at the licence grid. That shows exactly what licence is needed where.
Darren, Phil (Kilmeedyman) and I have spent almost 2 years talking to all the licence providers on behalf of djs. Believe me, we have found laws and regulations you have never even thought of.

As I mentioned earlier, I have had some amazing phone calls with PPL (who originally told me there was no problem with making copies of CDs, and have also threatened legal action and employed solicitors to take action on something they were completely wrong about!). I have also had similar calls with MCPS.
....as for the reason that I'm trying to be forceful on this one: I don't want you, and others, paying out a lot of money on what is, in fact, a white elephant for you.
By all means, if you can get someone from MCPS - or any other 'governing body' on here, please do so, but I suspect their answer will be that they are dealing with the LWP as representatives of the industry and don't see the point in duplication.

I don't want to email anyone. They don't want to deal with individual DJs on a daily basis (their words) as they don't have enought time or resources. This is why they wanted to talk to the LWP so that we could communicate what they were saying back to our friends and collegues in the industry.
If individual DJs are phoning up, they will get given misinformation by people who don't really know what they are talking about.
We know what the requirements are at the moment and we know they are working on new licences and there will be an amnesty 'till they sort it out.

As a member of LWP and having been to the offices of MCPS/ PRS (one place by the way) there is an even money chance that the person you spoke to was possibly a temp or a receptionist. When I first contacted them to purchase an SG6, the person I spoke to didn't even know what it was.
At our meetings with senior management of these organisations, we have found ourselves in the position of having to inform them of their policies. When Phil handedthem and their solicitor the licencing grid, which he put a lot of work into, they asked permission to use it themselves, admitting that we were better informed than they were. To this extent, I have had two problems regarding licences of theirs, where they have redirected people to us for information.
As they agree as a group, we are abou the best informed in the country at this time.
As for SG licences, at our second meeting, where their chairman was present, it was agreed by them that these licences were never intended for djs and are, in fact, totally inappropriate, although at this time they are the only things available. That is why we have been working extremely hard together to resolve a problem that has gone on for 40 years.
As you were informed earlier in the thread, at a meeting between the LWP & MCPS/PRS an amnesty was agreed until the situation is resolved.
But, obviously, if somebody does not want to be advised and wishes to pay for a non-essential licence, they will happily take their money.

Why do that not make this available on their web site to clarify it to those who are not members of the LWP, or those that have never even heard of the LWP.
Very poor for such an organisation to continue to confuse people, both from their web site and telephone. Bunch of..............

I agree and sorry to bang on about it, but this is why the LWP was set up, to lobby them and to inform people in our industry, whether it be by word of mouth or forums, to what is happening, rather than one man ringing up and getting wrong information.

sadly it is like many other things in this country they are not obliged to tell you and i suspect won't while there is still people willing to part with cash because they believe they need something.

Too late.
We have already submitted to The Gower report, who requested our input.
And, more importantly, the LWP has the full backing of the BPI, whose chairman shook our hands on it after our meeting with them.

Would it take rocket science to invite the top nobs of the MCPS-PRS to the forum to actually hear the points of us lowly DJ's as they're continued knuckle dragging is just plain ridiculous rather than continue to argue it with those whom are at the pinicle of there DJ career and the record labels.
I regularly get CD & MP3 promo's off several top dance labels all whom have given me permission to transfer the data to which ever format I desire. Therefore flouting they're own rules making a mockery of there whole society influence and credibility, regardless of amnesty or not??
If I put down a ruler upon paper and draw a line thats it line drawn, wether solid or broken the line has be made guidelines sorted etc etc
Now stop the MCPS-PRS taking the mickey of us DJ's and give us what we need as Professional Entertainers and stop them dragging there knuckles PLEASE
by all means forward this comment to them if you wish

Why don't you read the rest of the thread instead of making these comments which are pointless Badger?
Things aren't as clear cut as you make out. There is red tape a plenty and you really think you are going to help by telling them not to drag their knuckles?
They don't want to spend time talking to loads of DJs and don't want to come on forums to discuss this. That is the whole point of the LWP.
Have you read, digested and learned nothing from this thread at all?

Yes I have read thread after thread after thread regarding this issue. and everythings smacks of knuckle dragging so they get everything in their favour time after time.
Its either time they stopped and gave us a final answer before more loopholes arrive ie MP4, 5 or 6 or we actually got PAID for continual promtion of their tracks??? Thats what we do weekend after weekend after all?
I understand & respect what the LWP is doing but a resound kick up the rear end of the MCPS & PRS never hurts every now and then??. The longer this issue drags on the more confused all DJ's around the world will be?? Im sorry if I may seem to be droning on but at least Im verbally saying OOii what the hell is going on???

In essence, I agree, but there's nothing we can do about it. No-one is pressuring them to get on with it, so why should they resolve the situation in any hurry?
Not sure about the promoting tracks part though. I don't see how we're promoting tracks from the likes of Candi Staton and the Nolans - has anyone ever came up to you to ask who the artist was when playing tracks like that?
As for new music, well, I'm afraid to say we hardly promote them either. We play the new tracks after radio play has made them popular - if you play unknown tracks which you know are going to chart, you will get blank looks all around the room. Play it again after it's been given a run on the radio, and people react to it.

or we actually got PAID for continual promtion of their tracks??? Thats what we do weekend after weekend after all? Irelevant to the thread & not what we do at all (unless we work in specialist clubs)
